We have seen how, since the human beings organized themselves in groups and states, the bases of the international primary right began to be developed to regulate the relations between the different communities, in the best interest of its co-habitants. In 1864, after instances of the "International Committee for help to the Wounded Armies in the Field” the first treaty of humanitarian international right was signed. Since then, they were born, became rich, were adapted and were extinguished numerous treaties, international agreements, declarations, protocols, agreements and conventions which, among other things, intended general regulations on international social politics, always in benefit of the human beings
At the present time they exist, with legal use and force of legislation, gorgeous instruments for the protection of human, economic, social, cultural, civil, and even political rights; for the protection of children and woman’s rights, of the refugees and the prisoners’ rights, of the workers and the natives’ rights, of the handicapped and sick people’ rights, of the foreigners and the stateless’ rights; against the terrorism, the organized crime, the capital punishment, the discrimination, the intolerance, the slavery, the traffic and the forced disappearance of people, the torture and other cruel, inhumane or degrading treatments or pains; even they exist dispositions relative to the hunger, the under nutrition, the marriage, the freedom of association, the personal data, the right for the peace, the social progress and the development. Nevertheless, I have still not been able to find an obligatory international disposition that protects the will of the majorities.
Observing day by day the demonstrations against the war that take place in almost all the countries of the world, the doubt has assaulted me on the possibility that the war is really accepted, as the supposed surveys indicate, by most of the citizens of the nations involved on it. That is to say, is it possible that the collective will is one and other different the will of the institutions that in theory represent the first one? And I ask myself the reason why we the world citizens do not own some means to restrict our governors from not making important decisions that do not count with the majority’ support. Is it not assumed that the democracy is a general aspiration in which the greater degree of participation of the populace is pursued?
Why it has not been devised a worldwide instrument so that the states’ power holders respect the will of most of the humanity? A delineated treaty so that it is the majority the one that makes the most crucial and significant decisions, preventing the governmental heads from authoritarian opposing the general interests. An international tool that forces the national previous consultation, - through plebiscite, referendum, popular consultancy or any other means that are designed for the free and direct manifestation of the will, without falsifications nor distortions - for the approval or rejection of as important decisions as the one to declare or to support a war. That same means would serve, in addition, to consult subjects that, by their importance, would not have to be determined by unilateral visions of some minorities. For example, the sovereignty or form of government (adhesion or independence of a state or nation), the origin of nationality (jus soli or jus sanguinis), the justice (if the members of the judicial power must or not be permanent), the drug (if it is valid in each country a legalization that is expanding), the abortion (if it must or not be punished), and in aim, questions that affect all the inhabitants of a territory in a general and in a particular way.
Perhaps canalizing this way the majority’ will of each nation is an utopia, (an impossible one, a gorgeous dreaming awake, says my husband). Perhaps. Anyway, the humanity deserves a little more of respect.
When the inhabitants of each country choose their representatives they don’t do it with the conception of granting omnipotent authorization that is able to go opposite to them. They choose them in the belief of a commitment of fidelity to them, the represented. Then, why don’t? Proposing, reasoning, and debating an agreement for the dominance of the majority’s will sound simply logical.
